PHMSA proposing changes to hazmat transport regs

The Pipeline and Hazardous Materials Safety Administration (PHMSA) proposes amending the Hazardous Materials Regulations (HMR) to incorporate provisions contained in certain widely used or longstanding cargo tank special permits that have been granted to multiple parties and have an established safety record.

PHMSA would add the following the HMR:

Authorization to transport liquefied petroleum gas (LP-Gas) in non-DOT specification cargo tank motor vehicles known as moveable fuel storage tenders that are used exclusively for agricultural purposes.

Authorization to transport Division 6.1 liquid soil pesticide fumigants in DOT-Specification MC306 and DOT406 cargo tank motor vehicles and DOT57 portable tanks, used exclusively for agricultural purposes.

Authorization to transport certain hazardous materials used for roadway striping in non-DOT-specification cargo tanks.

Authorization for private motor carriers to transport LP-Gas in consumer storage containers with quantities greater than 5% of the container's water capacity.

Authorization to transport nurse tanks securely mounted on field trucks.

Authorization for nurse tanks with missing or illegible ASME plates to continue to be used in anhydrous ammonia service under specified conditions.

Comments must be received by August 20, 2010.
