The District of Columbia Council has again approved legislation that would require a permit for transporting certain hazardous materials within 2.2 miles of the US Capitol, according to Council information.

The Council enacted the Second Terrorism Prevention in Hazardous Materials Transportation 13 Emergency Act of 2005 December 24 to be in effect for 90 days.

The latest action repeats a decision by the Council in February of 2005 that brought legal protests resulting in the US Court of Appeals for the District of Columbia blocking the emergency ban.

The American Trucking Associations (ATA) has been active in opposing the ban and has filed a preemption petition with the Department of Transportation and an amicus brief with a Federal District Court, according to ATA information.
