The National Industrial Transportation League (NITL) and CSX Transportation Inc (CSX) are challenging a February ordinance by the District of Columbia Council to require permits for transporting hazmat products within two miles of the Washington Capitol and federal buildings, according to NITL information.
NITL posted on its Web site its February 22 motion in the US District Court in the District of Columbia that supports an earlier appeal by CSX to reverse the ordinance.
The governing body for the District of Columbia approved emergency legislation February 1 that would require the permit.
The council decision was made as part of an increased security effort for hazmat transportation.
Products expected to fall under the permit include Class 1 explosives, Class 2 flammable gasses, Class 2 poisonous gasses, and Class 6 poisonous materials.
