EPA extends certain SPCC compliance dates

The Environmental Protection Agency (EPA) has given a 12-month extension to upcoming compliance dates for certain Spill Prevention Control and Countermeasure (SPCC) amendments, according to information in the Federal Register June 17.

The Environmental Protection Agency (EPA) has given a 12-month extension to upcoming compliance dates for certain Spill Prevention Control and Countermeasure (SPCC) amendments, according to information in the Federal Register June 17. The rule, 40 CFR Part 112, application includes storage and terminaling facilities and was discussed at the Independent Liquid Terminals Association conference in Houston TX June 14-15. At that time, ILTA members were anticipating the extension. The regulation also applies to certain tank cleaning facilities.

The dates affected would be the dates for facilities to amend plans and plans implementation. In light of a recent partial settlement of litigation involving the amendments, EPA is proposing the extension to, among other things, provide sufficient time for the regulated community to undertake the actions necessary to update or prepare their plans. The proposed extension is also intended to alleviate the need for individual extension requests.

Compliance for most facilities initially was extended to August 17, 2004, and full implementation would have been required by February 18, 2005. In addition, facilities that become operational after February 18, 2005 must prepare and implement an SPCC plan before commencement of operations.
